These Terms of Service ("Terms") govern your use of the TaxSwipe mobile application ("Service") operated by FinMedTech ("we", "us", "our").
By creating an account or using TaxSwipe, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account and using TaxSwipe, you confirm that:
- You are at least 18 years of age
- You are a UK sole trader or self-employed individual
- You have the legal capacity to enter into this agreement
- All information you provide is accurate and truthful
2. Description of Service
TaxSwipe is a mobile application designed to help UK sole traders and self-employed individuals:
- Import transactions via PDF bank statements, CSV files, or manual entry
- Categorise business expenses according to HMRC categories
- Calculate Income Tax and National Insurance contributions
- Submit quarterly Making Tax Digital (MTD) updates to HMRC
- Submit year-end annual adjustments and the Final Declaration to HMRC
- Track tax liabilities and submission history
Scope of the Service: TaxSwipe currently supports self-employment income only. If you also receive UK property income, TaxSwipe records it to determine whether Making Tax Digital applies to you, but does not submit property updates to HMRC. If you are required to report property income under MTD, you must do so using other means alongside TaxSwipe. Partnership income is not supported.
3. Tax and Accounting Disclaimer
IMPORTANT: TaxSwipe is a tool to assist with tax compliance. It is NOT:
- A substitute for professional tax advice
- An accounting firm or registered tax agent
- Responsible for errors in your tax submissions
- A guarantee of HMRC acceptance of your returns
You should consult a qualified accountant or tax professional for:
- Complex tax situations
- Tax planning and optimisation
- Disputes with HMRC
- Income outside self-employment (property, partnerships, capital gains, foreign income)
AI Disclaimer
TaxSwipe uses AI (Anthropic Claude) to suggest expense categories. AI suggestions are not guarantees of correctness. You must review and approve all categorisations before submitting to HMRC. The AI has no knowledge of your complete tax situation.
4. User Responsibilities
4.1 Accurate Information
You are responsible for:
- Providing accurate personal information (name, email, National Insurance Number)
- Correctly categorising transactions as business or personal
- Reviewing all calculations before submitting to HMRC
- Ensuring all HMRC submissions are accurate and complete
4.2 Account Security
You must:
- Keep your account credentials secure
- Enable biometric authentication (Face ID/Touch ID) where available
- Notify us immediately of any unauthorised access
- Not share your account with others
4.3 Compliance
You agree to:
- Comply with all UK tax laws and HMRC regulations
- Use the Service only for lawful purposes
- Not attempt to circumvent security measures
- Not use the Service for fraudulent activities
5. Making Tax Digital (MTD) Compliance
TaxSwipe facilitates MTD compliance by:
- Storing digital records of income and expenses
- Submitting quarterly updates to HMRC via their API
- Submitting year-end annual adjustments and the Final Declaration via HMRC's API
- Maintaining submission history and HMRC references
However, you remain solely responsible for:
- Meeting all HMRC MTD requirements, including for any income TaxSwipe does not submit (see Scope of the Service above)
- Submitting accurate quarterly updates
- Reviewing and approving your year-end Final Declaration, which under MTD replaces the traditional Self Assessment return for your covered income
- Paying tax owed to HMRC on time
6. Third-Party Services
6.1 HMRC Integration
By connecting to HMRC, you authorise TaxSwipe to:
- Access your HMRC Business Details and obligations
- Submit quarterly MTD updates on your behalf
- Trigger and retrieve tax calculations
- Submit annual adjustments and your Final Declaration on your behalf, after your explicit in-app confirmation
- Retrieve submission history
You can disconnect from HMRC at any time via Settings.
6.2 Anthropic (AI Categorisation)
AI expense categorisation suggestions are provided by Anthropic Claude. AI suggestions are not guarantees of correctness. You must review and accept responsibility for all AI-assisted categorisations.
7. Fees and Payment
Some features of TaxSwipe — including submitting to HMRC — require either a one-off submission credit or an active subscription. Payments are processed entirely by Apple (App Store) or Google (Play Store); we do not receive or store your payment card details. Purchase terms and pricing are displayed in the app before purchase.
- A credit or plan allowance is used on the first submission of each quarterly period. Amendments to an already-submitted period, and your year-end Final Declaration, are always free.
- The annual pass covers the UK tax year (6 April – 5 April), not 12 months from purchase, and is pro-rated if bought mid-year.
- If your subscription lapses, your data is retained but in-app access may be limited to your most recent uploads until you resubscribe or purchase a credit. You can export your data or delete your account at any time regardless of subscription status.
8. Service Availability
We strive to provide reliable service, but we do not guarantee:
- Uninterrupted access to TaxSwipe
- Error-free operation
- Availability during HMRC maintenance windows
- Compatibility with all devices or operating systems
We reserve the right to modify, suspend, or discontinue the Service at any time.
9. Intellectual Property
TaxSwipe and all its contents (design, code, logos, trademarks) are owned by FinMedTech. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, reverse engineer, or create derivative works based on TaxSwipe.
10. Limitation of Liability
To the fullest extent permitted by applicable law:
- We are NOT liable for incorrect tax calculations resulting from inaccurate data entry
- We are NOT liable for HMRC penalties or interest charges
- We are NOT liable for third-party service failures (HMRC API downtime, AWS service interruptions)
- We are NOT liable for incorrect AI categorisation suggestions
- Our total liability shall not exceed the fees you paid in the last 12 months (if applicable)
You are solely responsible for:
- Reviewing all tax calculations before submission
- Ensuring compliance with HMRC requirements
- Paying taxes owed to HMRC
- Maintaining accurate records
11. Data Retention and Deletion
You can delete your account at any time via Settings → Delete Account. Upon deletion:
- All personal data will be permanently deleted from our servers
- HMRC connection will be immediately disconnected
- All transaction data will be permanently deleted
- HMRC submission records may be retained for 6 years to comply with UK tax record-keeping requirements
12. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using TaxSwipe, you consent to the collection and use of your data as described in the Privacy Policy.
13. Termination
We may terminate or suspend your account if you violate these Terms, engage in fraudulent activity, provide false information, or we are required to do so by law. You may terminate your account at any time by using the Delete Account feature.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via the app. Continued use of TaxSwipe after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FinMedTech regarding your use of TaxSwipe.
